This Privacy Policy explains how Perfero Pharma, Inc. (“Company,” “we,” “us,” or “our”) collects, uses, discloses and protects information about you when you visit www.perfero.com (the “Site”) or when you otherwise provide us with information about you. Please read this Privacy Policy in full to understand our privacy practices before you use our website or provide us with information about you. By using the Site, you agree to the practices described in this Privacy Policy.

This Privacy Policy applies to information collected through the Site as well as offline.

If you are a Nevada resident or if your consumer health data is collected in Nevada, or if you are a Washington resident or if your consumer health data is collected in Washington, please also see our separate Consumer Health Data Privacy Policy, linked in the footer of the Site, which governs our collection, use and sharing of consumer health data as defined under Nevada Revised Statutes Chapter 603A and Washington’s My Health My Data Act (RCW 19.373). That notice, and not this general Privacy Policy, is the controlling notice with respect to Nevada and Washington consumer health data.

1. Information We Collect

Information You Provide Directly

We collect information you voluntarily provide when you interact with us, including when you:

  • Contact us through a web form, email or phone number listed on the Site
  • Sign up for a newsletter, patient support program, savings card or refund/reimbursement program
  • Report a side effect, product complaint or adverse event
  • Apply for a job or submit a resume through our careers page
  • Participate in a survey, contest or promotion
  • Interact with our adverse reaction hotline

This includes:

  • Name
  • Email address
  • The content of your message
  • Phone number
  • Government-issued identification number
  • Information about the product you purchased or used
  • Professional and employment information, such as job title or company name
  • Adverse event and side effect information, which may constitute medical information or consumer health information

Information Collected Automatically

When you visit the Site, we and our service providers automatically collect certain information using cookies, web beacons and similar technologies, including:

  • Device and browser type, and operating system
  • Pages viewed, links clicked, time spent on pages and referring/exit URLs
  • Approximate geographic location

Information From Other Sources

We may receive information about you from third parties, such as pharmacies, distributors, marketing partners or publicly available sources, and combine it with information we collect directly from you, consistent with this Privacy Policy.

2. How We Use Your Information

We use the information we collect to:

  • Respond to inquiries and provide customer support
  • Administer customer support, savings or refund programs, including verifying and processing refund requests
  • Assist you in the fulfillment of product orders
  • Operate, maintain and improve the Site
  • Send newsletters or marketing communications, where you have opted in or as otherwise permitted by law
  • Comply with legal, regulatory and safety obligations, including pharmacovigilance and adverse event reporting requirements
  • Detect, investigate and prevent fraud, abuse or security incidents

3. Sensitive and Health-Related Information

Because of the nature of our business, some information you provide (for example, the name of a product you use or information shared in an adverse event or product complaint report) may be considered sensitive personal information or “consumer health data” under certain state laws, even though it is not medical record information and we are not your health care provider.

We do not sell this category of information, and we do not use it for advertising targeted to you based on that information. Where required by applicable state law, we will obtain your affirmative, opt-in consent before collecting or processing consumer health data for purposes beyond providing the specific product or service you requested, and we will honor requests to withdraw that consent. Depending on the state you reside in, our separate Consumer Health Data Privacy Policy provides additional required disclosures, including the specific categories of third parties with whom consumer health data is shared, and is the controlling notice for that data.

We are not a “covered entity” under the Health Insurance Portability and Accountability Act (“HIPAA”), and information submitted through the Site is generally not “protected health information” under HIPAA.

4. How We Share Your Information

We may share the information you provide with:

  • Service providers who perform business functions on our behalf, such as hosting, customer support, payment processing and program administration, under contractual confidentiality and use restrictions
  • Regulators and government authorities, where required by law (for example, FDA adverse event reporting)
  • Professional advisors, such as legal and accounting firms, and in connection with mergers, acquisitions, financings, sales, restructurings, or other corporate transactions
  • A successor entity in connection with a merger, financing or sale of assets
  • Marketing and analytics partners
  • Health care providers, pharmacies, insurance companies, or other third parties, where you have directed us to share information with them or where such sharing is required or authorized by law
  • Our product manufacturing partners and licensors
  • Other parties with your consent or at your direction

5. Cookies, Tracking Technologies and Opt-Out Preference Signals

We use cookies and similar technologies to operate the Site and understand how visitors use the Site, including through analytics providers, such as Google Analytics. You can control cookies by managing the preference settings on your browser and device or communicating directly with Google as explained at: https://policies.google.com/technologies/partner-sites. If you restrict the use of cookies and other technologies, you may affect the functionality of the Site.

6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, including to respond to your inquiries, comply with legal and regulatory obligations, communicate with you, resolve disputes and enforce our agreements, after which it is securely deleted or de-identified.

7. Your Privacy Rights and Choices

Depending on your state of residence, you may have the right to:

  • Confirm whether we process personal information about you, and access a copy of it
  • Correct inaccurate personal information
  • Delete personal information we hold about you
  • Obtain a portable copy of your personal information
  • Opt out of the sale or sharing of personal information, targeted advertising, or profiling in furtherance of decisions that produce a legal or similarly significant effect concerning you
  • Withdraw previously given consent, including consent to collect or process consumer health data
  • Not receive retaliation or discriminatory treatment for exercising your privacy rights

To exercise these rights, you may contact us by email at privacy@perfero.com. We will verify your request and respond within the time period required by applicable law. You may designate an authorized agent to submit a request on your behalf, subject to verification. If we deny your request, we will provide you with a response including a justification for the denial and instructions regarding your right to appeal. You may appeal our decision by contacting us at privacy@perfero.com with the subject line “Privacy Appeal.” We will respond to your appeal within the time period required by applicable law. If we deny your appeal, we will provide you with information on how to submit a complaint to the applicable state authorities.

8. Data Security

We maintain administrative, technical and physical safeguards designed to protect your personal information from unauthorized access, use or disclosure, consistent with the sensitivity of the information involved. Despite these precautions, however, we cannot guarantee the security of information transmitted over the Internet or that unauthorized persons will not obtain access to personal information.

9. Children’s Privacy

The Site is not directed to children under the age of 16, and we do not knowingly collect personal information from children under 13 without verifiable parental consent or from children ages 13 to 15 without consent as required by applicable law. If you believe a child has provided us with personal information, please contact us at privacy@perfero.com and we will take appropriate steps to delete it.

10. International Users

The Site is intended for users located in the United States only. If you access the Site from outside the United States, your information will be transferred to, stored and processed in the United States, which may have different data protection laws than your country of residence.

11. Adverse Event and Product Complaint Reporting

If you contact us to report a side effect or product complaint, we may be legally required to report certain information to the U.S. Food and Drug Administration (‘FDA’) or other regulators and to retain it for as long as required under applicable pharmacovigilance recordkeeping requirements, notwithstanding any deletion request. We will only use this information for safety reporting, quality and regulatory compliance purposes.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will post the updated Privacy Policy on the Site and update the “Last Updated” date above, and, where required by law, provide additional notice.
